Does South Carolina Tax Tips in 2026?

Yes - South Carolina taxes tips for 2026. SC Information Letter #26-20 lists the "Qualified tip deduction" among the federal deductions South Carolina does not adopt for tax years beginning after 2025 (Act 110 of 2026). The SC Income Adjusted Deduction replaces the federal deductions. For 2025 returns, the federal deduction did reduce SC income.

How South Carolina's Tips Tax Treatment Works

What changed in 2026: Act 110 of 2026 (H.4216) decoupled South Carolina from federal standard and itemized deductions. It added S.C. Code §12-6-50(21), effective March 30, 2026, which provides that Internal Revenue Code "Section 63(b) through (g)...specifically not allowed or adopted" by South Carolina. SC taxable income now begins with federal AGI, followed by the SC Income Adjusted Deduction.

SCDOR's list: the statute does not name individual deductions. Information Letter #26-20 names the deductions dropped as a result, including the senior deduction, the qualified tip deduction, and the overtime deduction.

2025 vs 2026: the 2025 SC1040 started from federal taxable income, so the federal deduction lowered 2025 SC income. From 2026 it does not.

Worked Examples Comparing Federal and South Carolina Treatment

Example 1: Restaurant server with $20,000 in tips (single filer, 12% federal bracket)

Federal return:
Qualified tip income: $20,000
Tips deduction claimed: $20,000 (capped at $25,000)
Estimated federal tax savings: $2,400.00

South Carolina return:
For 2026 South Carolina does not adopt this deduction, so the full $20,000 stays in SC income. Where SC taxable income is $30,000 or more, that is about $1,042 of SC tax at 5.21%.

Example 2: Bartender at the federal cap, $25,000 deducted (single filer, 22% federal bracket)

Federal return:
Qualified tip income: $25,000
Tips deduction claimed: $25,000 (capped at $25,000)
Estimated federal tax savings: $5,500.00

South Carolina return:
The federal deduction saves federal tax only. On the 2026 SC return the $25,000 is still income, about $1,303 of SC tax at 5.21%.

Frequently Asked Questions

Does South Carolina tax tips in 2026?
Yes. SC Information Letter #26-20 lists the "Qualified tip deduction" among the federal deductions South Carolina does not adopt for tax years beginning after 2025, under Act 110 of 2026.
Which federal deductions does South Carolina not adopt?
IL #26-20 lists: the standard deduction; itemized deductions on Schedule A; the senior deduction; the qualified tip deduction; the overtime deduction; the car loan interest deduction; the qualified business income deduction; and the charitable deduction for non-itemizers. The SC Income Adjusted Deduction (SCIAD) replaces them.
What about my 2025 South Carolina return?
2025 is different. Act 110 applies from tax year 2026. For 2025, the SC1040 started from federal taxable income, which already reflects the federal tips deduction, so it did reduce 2025 SC income.
Does starting from federal AGI change anything?
It points the same way. For 2026, SC taxable income begins with federal AGI, and the federal tips deduction is taken after AGI, so it would not reach the SC return even without the explicit list.
Do I still get the federal deduction?
Yes. The federal deduction, up to $25,000, applies on your federal return regardless of South Carolina's rules.
